Our Agreement

fleksign.com is operated by Individual Entrepreneur Pavel Safonov, duly registered under the laws of Georgia, Identification Number: 322779025, with a registered address at Georgia, Adigeni region, Varkhani village, 7th Street, N7, 0305 (hereinafter referred to as “fleksign.com”, “we”, “us”, or the “Service Provider”). fleksign.com provides digital SaaS tools for iOS developers, QA engineers, and internal software teams (the “Service”). The Service helps authorized users manage, prepare, sign, launch, and test their own iOS application builds or applications they are legally permitted to use for development, QA, internal testing, or pre-release validation purposes.

The Service is not an app store, marketplace, file-sharing service, or distribution platform for third-party applications. We do not sell Apple accounts, Apple Developer accounts, Apple Developer certificates, third-party applications, copyrighted content, gift cards, or physical goods.

These Terms of Service are an agreement between you and fleksign.com regarding your use of the fleksign.com Service. fleksign.com provides the Service subject to these Terms of Service. These Terms of Service may be revised from time to time. By using the Service, you agree to be bound and to abide by the most recent version of these Terms of Service. Some fleksign.com services and accounts have additional terms and conditions (“Additional Terms”). Where Additional Terms apply to a service or account, we will make them available for you to read through your use of that service or account. By using the services or account, you agree to be bound and to abide by the most recent version of Additional Terms. As used in these Terms of Service, “fleksign.com” means the Service Provider as defined above and the fleksign.com Service it operates, and “user” means any user of the fleksign.com Service, including but not limited to any account holder, customer, plan holder, developer, or device-based access holder. We explain these terms in more detail below.

The FlekSign / FlekDeck Service

fleksign.com provides access to cloud-based software tools for managing and testing iOS application builds. The Service may include account access, device-based access, Premium plan activation, build preparation, code-signing-related workflows, FlekDeck access, and other software features made available through the fleksign.com platform.

FlekDeck is a client application and product interface provided as part of the Service. It allows authorized users and developers to access, manage, and test their own iOS application builds, internal software, or applications they are legally permitted to use for development, QA, internal testing, or pre-release validation purposes.

FlekDeck was previously named FlekLauncher. The product was renamed, and the names FlekDeck and FlekLauncher refer to one and the same product. Any reference to FlekLauncher in earlier versions of these Terms, in the Service, in invoices, receipts, order confirmations, or in any other materials shall be read as a reference to FlekDeck. The renaming does not change the scope of the Service, your plan, or any rights or obligations under these Terms.

Where technically required, the Service may perform signing, packaging, provisioning, or related technical operations as part of the software testing workflow. Any certificates, provisioning profiles, developer credentials, or technical assets used in this process are used only as part of providing the Service and are not sold, transferred, rented, or separately provided to customers.

Customers purchase digital access to the fleksign.com Service, not certificates, Apple accounts, Apple Developer accounts, third-party applications, copyrighted content, gift cards, marketplace goods, or physical goods.

Access to the Service may be provided through paid plans, account activation, device-based activation, Premium access periods, license access, or other digital access mechanisms. These mechanisms are used only to control access to the fleksign.com SaaS platform and do not represent the sale of a separate certificate, Apple account, third-party application, or physical item.

fleksign.com may update, improve, modify, suspend, or discontinue certain features of the Service from time to time. We will make commercially reasonable efforts to avoid unnecessary disruption to active customers, where practical.

Some changes may be required for security, legal, technical, payment provider, platform, infrastructure, or operational reasons. In such cases, changes may be made without prior notice if immediate action is reasonably necessary.

fleksign.com may refuse, suspend, or terminate access to the Service if we reasonably believe that a user has violated these Terms, applicable law, third-party rights, payment provider rules, platform rules, or is using the Service for fraud, abuse, copyright infringement, unauthorized third-party applications, illegal activity, or other prohibited purposes.

The Service is provided on an “as is” and “as available” basis, subject to these Terms and any rights that cannot be excluded under applicable law.

fleksign.com does not provide long-term storage of files uploaded to the Service. Once the user downloads the resulting file, it is immediately removed from the fleksign.com server, or automatically deleted 1 hour after upload.

Lawful Use and Prohibited Activities

The Service may be used only for lawful development, QA, internal testing, pre-release validation, and other authorized software workflows.

You may only upload, process, sign, import, launch, test, or otherwise use application files, builds, certificates, provisioning profiles, content, or related materials if you own them or have all necessary rights, licenses, permissions, and authorizations to use them.

You must not use the Service to upload, process, sign, launch, test, distribute, access, or make available any application, file, content, certificate, profile, credential, or software that infringes the intellectual property rights, privacy rights, contractual rights, or other rights of any third party.

The following activities are strictly prohibited:

  • using the Service for piracy, copyright infringement, or unauthorized access to third-party applications;
  • uploading, signing, importing, launching, testing, or distributing applications that you do not own or are not authorized to use;
  • using the Service to sell, transfer, rent, share, or distribute Apple accounts, Apple Developer accounts, Apple Developer certificates, provisioning profiles, credentials, or access to such assets;
  • using the Service as an app store, marketplace, file-sharing service, or distribution platform for third-party applications;
  • using the Service for fraud, abuse, malware, circumvention of security systems, illegal activity, or violation of applicable laws;
  • attempting to resell, share, transfer, or provide access to your account, license access, device activation, or Premium plan to unauthorized third parties.

We may suspend or terminate access to the Service if we reasonably believe that the Service is being used in violation of these Terms, applicable law, intellectual property rights, payment provider rules, platform rules, or any third-party rights.

General Conditions On Use of the Service

fleksign.com grants you permission to access and use the Service as set forth in these Terms of Service, and in exchange you agree as follows:

  • You will not grant access, share or sell your account/accounts under any circumstances to any 3rd party persons.
  • You will not use the Service for any illegal purpose, in any manner that is illegal, or in any other manner that could damage, disable, overburden or impair the Service
  • You will not defeat or interfere with any security feature of the Service
  • You will not use any automated system, software, or device to index, compile, collect or copy any content residing on servers used by the Service

You understand and agree that fleksign.com may immediately terminate the account of, or suspend or terminate access to the Service by, a user that violates any of these prohibitions.

Specific Conditions for Use of the Service for the Developers

The Developers must be over 16 years old to use the Service, and fleksign.com reserves the right to check their legal age. All User accounts are exclusive, personal, and non-transferable.

Developers and Users are solely responsible for any application files, builds, content, certificates, profiles, metadata, or other materials they upload, import, process, sign, launch, test, or otherwise use through the Service (collectively, the “Applications”).

By using the Service, you represent and warrant that:

  • you own the applications and materials you use through the Service, or you have all necessary rights, licenses, permissions, and authorizations to use them;
  • your use of the Service does not infringe any copyright, trademark, trade secret, privacy right, contractual right, platform rule, or other right of any third party;
  • you will not use the Service to access, process, sign, launch, test, distribute, or make available any third-party application without authorization;
  • you will not use the Service for piracy, unauthorized software distribution, malware, fraud, abuse, or any unlawful purpose.

We may remove access to any content, application, account, device, license access, or Premium plan if we reasonably believe that it violates these Terms, applicable law, third-party rights, payment provider rules, or platform rules.

You agree that you will not use the Service or the Site to post, transmit, share, or process child sexual abuse material (CSAM). Such use will not be tolerated, will be reported to law enforcement authorities, and will result in termination of your account. You further agree that you will not use the Service to upload, process, sign, test, or otherwise handle Applications that fall into, or contain content that falls into, any of the following categories:

  • intended for any illegal purpose, or in violation of applicable laws;
  • infringing the intellectual property, privacy, or contractual rights of any third party;
  • malware, exploits, or software designed to circumvent security systems or gain unauthorized access;
  • advocating or promoting terrorism;
  • graphically violent or likely to incite imminent violence.

By uploading, processing, signing, testing, or otherwise using Applications through the Service, you promise that they do not fall into any of these prohibited categories. You understand and agree that fleksign.com may immediately suspend access to, terminate, or remove, without notice, any account or content that violates any of these prohibitions. You understand that fleksign.com does not promise that Applications you upload, process, or use through the Service will be maintained by fleksign.com. You are solely responsible for creating backup copies of and replacing any Applications, at your own cost and expense. You agree that fleksign.com has no responsibility or liability for the deletion of, or the failure to store or to transmit, any Applications. fleksign.com retains the right to create and revise limits on use, storage, upload and download speeds, maximum number of users, and any other aspect of the Service, at its sole discretion and at any time, with or without notice.

General Terms and Conditions

No Waiver. The failure or inability of fleksign.com to exercise or enforce any right or provision of these Terms of Service will not constitute a waiver of such right or provision. The failure or inability of fleksign.com to take action to address any violation of these Terms of Service will not deprive fleksign.com of the right to take measures to address any subsequent or similar violations.

Assignment. fleksign.com may assign its rights and obligations under these Terms of Service to any third party that acquires an interest in fleksign.com, and may delegate obligations under these Terms of Service to third parties retained by fleksign.com. No user may transfer or assign any rights or duties under these Terms of Service to any other person or entity, and any purported transfer or assignment of such rights or duties shall be void.

Severability. If any provision of these Terms of Service is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible and all other provisions of these Terms of Service will remain in effect.

Entire Agreement. These Terms of Service, together with fleksign.com’s Intellectual Property and Rights Policy, Privacy Policy, and Refund Policy, constitute the entire agreement between you and fleksign.com and govern your use of the Service, superseding any prior discussions or agreements between you and fleksign.com.

Disclaimer

All the materials on fleksign.com’s Website are provided “as is”. fleksign.com makes no warranties, may it be expressed or implied, therefore negates all other warranties. Furthermore, fleksign.com does not make any representations concerning the accuracy or reliability of the use of the materials on its Website or otherwise relating to such materials or any sites linked to this Website.

Limitations

fleksign.com or its suppliers will not be hold accountable for any damages that will arise with the use or inability to use the materials on fleksign.com’s Website, even if fleksign.com or an authorize representative of this Website has been notified, orally or written, of the possibility of such damage. Some jurisdiction does not allow limitations on implied warranties or limitations of liability for incidental damages, these limitations may not apply to you.

Revisions and Errata

The materials appearing on fleksign.com’s Website may include technical, typographical, or photographic errors. fleksign.com will not promise that any of the materials in this Website are accurate, complete, or current. fleksign.com may change the materials contained on its Website at any time without notice. fleksign.com does not make any commitment to update the materials.
